Maternity Benefit Act India Compliance Software 2026 — 26 Weeks Leave

The Maternity Benefit (Amendment) Act 2017 extended paid maternity leave to 26 weeks for women who have fewer than 2 surviving children. The Act now also mandates work-from-home options, nursing breaks, and creche facilities at workplaces with 50+ employees. Non-compliance — even accidental, through incorrect leave calculation or delayed pay — exposes employers to criminal liability and labour court proceedings.

Maternity Benefit Act — Key Provisions

Eligibility

  • Female employee who has worked for at least 80 days in the 12 months preceding delivery
  • Applicable to all establishments with 10 or more employees

Leave Duration

  • 26 weeks for women with less than 2 surviving children (amended 2017)
  • 12 weeks for women with 2 or more surviving children
  • 6 weeks for miscarriage or medical termination of pregnancy
  • 12 weeks for commissioning mother (surrogacy) and adoptive mother adopting a child below 3 months

Pay During Maternity Leave

  • Full wages during maternity leave: at the rate of average daily wages
  • Average daily wages: computed from the 3 months preceding the maternity leave
  • No deduction from maternity leave pay is permitted
  • Benefit paid by employer; if ESI covered, ESIC reimburses the employer for covered employees

Nursing Breaks

  • Women who have infants are entitled to 2 nursing breaks per day until the child is 15 months old
  • Nursing breaks in addition to regular rest intervals

Creche Facility (Establishments with 50+ Employees)

  • Creche within prescribed distance from workplace
  • Woman employee permitted to visit creche 4 times a day (including nursing break)
  • Alternatively, employer can provide creche allowance

Work from Home

  • If nature of work permits, employer and employee may agree to work from home after maternity leave or during the leave period
  • Not a mandatory right but a negotiated accommodation

Prohibition on Dismissal

  • Employer cannot dismiss or give notice of dismissal to a pregnant employee during maternity leave
  • Dismissal during leave is void unless for gross misconduct unrelated to pregnancy

ESI and Maternity Benefit

For ESI-covered employees (earning up to Rs. 21,000/month):

  • Maternity benefit paid by ESIC directly to the employee from their 7th week before delivery
  • Employer is not liable to pay separately — ESIC handles the payment
  • Pre-natal and post-natal medical care: provided by ESI dispensary/hospital
  • Medical bonus: Rs. 5,000 if delivery not availed in ESI hospital

For non-ESI-covered employees (earning above Rs. 21,000/month):

  • Employer pays full maternity benefit
  • No ESIC reimbursement
  • Higher-income employees receive full salary continuation

  • Children count: employee declares number of surviving children

  • Leave marked separately: maternity leave not deducted from CL/EL balance
  • Increment during maternity leave: period counts for increment and seniority purposes

ESIC Maternity Benefit Coordination

  • Form 19: maternity benefit claim facilitation for covered employees
  • Expected date of delivery certificate: from ESI dispensary
  • Coordination with ESIC: ensure payment starts from the correct date
  • Employer certificate: Form 4 (employer's report of maternity) for ESIC claims

Nursing Break Tracking

  • Nursing break entitlement: active from return-to-work until child turns 15 months
  • Break schedule: 2 nursing breaks per day within work hours
  • Manager dashboard: flag employees on nursing break entitlement for awareness

Creche Compliance (50+ Employee Companies)

  • Creche facility documented or allowance configured in HRMS
  • Employee visits logged (4 per day permitted)
  • If allowance: monthly creche allowance added to payroll for eligible employees

Return to Work

  • Return date confirmation: employee confirms return on last day of leave
  • Gradual return option: if work-from-home agreed, transition managed in HRMS
  • TDS recomputation on return: annual tax projection updated for salary continuation
