The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013 — commonly called the POSH Act — is mandatory for every employer with 10 or more employees. The Act requires organisations to create a safe workplace for women, constitute an Internal Committee (IC) for complaint redressal, and submit an annual compliance report to the district officer.
Non-compliance penalties: up to Rs. 50,000 fine per violation, cancellation of business licence, and doubling of fine on repeat violation. Following high-profile workplace harassment cases, POSH enforcement has intensified significantly.

POSH Act Requirements
Internal Committee (IC) Constitution
- Minimum 4 members: presiding officer (senior woman employee), 2 employee members, 1 external member (NGO or expert)
- Presiding officer must be a woman
- At least 50% of IC members must be women
- External member must have experience in social work or women's rights
- IC members appointed for 3-year term
- IC reconstituted when terms expire

Confidentiality

Annual Report
- Submitted to District Officer each year
- Contents: number of complaints received, disposed, pending, action taken
- Companies filing under Companies Act: include POSH disclosure in Board Report (Section 134)
