The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013 — commonly called the POSH Act — is mandatory for every employer with 10 or more employees. The Act requires organisations to create a safe workplace for women, constitute an Internal Committee (IC) for complaint redressal, and submit an annual compliance report to the district officer.

Non-compliance penalties: up to Rs. 50,000 fine per violation, cancellation of business licence, and doubling of fine on repeat violation. Following high-profile workplace harassment cases, POSH enforcement has intensified significantly.

POSH Act Requirements

Internal Committee (IC) Constitution

  • Minimum 4 members: presiding officer (senior woman employee), 2 employee members, 1 external member (NGO or expert)
  • Presiding officer must be a woman
  • At least 50% of IC members must be women
  • External member must have experience in social work or women's rights
  • IC members appointed for 3-year term
  • IC reconstituted when terms expire

POSH Policy

  • Written POSH policy: definition of sexual harassment, complaint process, IC composition, investigation timeline, confidentiality
  • Policy communicated to all employees at joining and annually
  • Policy displayed at workplace

Awareness and Training

  • Annual training / awareness session for all employees: what is sexual harassment, how to report
  • IC members training: investigation procedure, natural justice, confidentiality
  • Training records maintained

Complaint Process

  • Complaint in writing: to IC within 3 months of the incident
  • IC can allow late complaint if circumstances warrant
  • Inquiry: completed within 90 days
  • Conciliation: if complainant opts for settlement (inquiry not required)
  • Action: IC recommends action to employer (transfer, warning, termination, compensation)
  • Employer must implement IC recommendation within 60 days
  • Appeal: against IC finding within 90 days

Confidentiality

  • All parties: complainant, respondent, witness — identities protected
  • IC proceedings: not published or disclosed
  • Violation of confidentiality: punishable

Annual Report

  • Submitted to District Officer each year
  • Contents: number of complaints received, disposed, pending, action taken
  • Companies filing under Companies Act: include POSH disclosure in Board Report (Section 134)

Third-Party Workplace

  • Employer responsible for sexual harassment of its employee even if the workplace is a client's office or a remote location
