The Minimum Wages Act 1948 requires every employer to pay employees at least the minimum wage fixed by the appropriate government (central or state) for the scheduled employment category. Paying below minimum wage is both a labour law violation and, in severe cases, a criminal offence. Yet non-compliance is widespread — often unintentional — because India has over 2,000 different minimum wage schedules across states, industries, and skill categories.

Complexity of India's Minimum Wage System
State vs. Central
- Central government fixes minimum wages for central sphere establishments (railways, mines, oilfields, major ports)
- State governments fix minimum wages for most other establishments
- Both central and state wages have variable rates by industry
Zone-Based Differentiation
- Many states divide geographically into zones with different minimum wages
- Maharashtra: Zone A (Mumbai), Zone B (other cities), Zone C (rural)
- Delhi: different rates for Delhi vs. extended areas
- An employer with workers in multiple zones must apply the correct zone rate per worker
Skill Category
- Unskilled: basic manual work requiring no specialised skill
- Semi-skilled: trained in a specific task but not fully qualified
- Skilled: requires certification, training, or demonstrated proficiency
- Highly skilled: advanced specialised skills
- Rates increase significantly across skill levels
Industry-Specific Rates
- Construction workers, garment workers, domestic workers, security guards, shop assistants — all have industry-specific rates
- Some industries have separate rates for day and night shifts
Dearness Allowance (DA)
- Many state minimum wages include a Variable Dearness Allowance revised twice yearly (January 1 and July 1)
- The employer must update wages whenever DA changes
- Missing the DA revision date means paying below minimum wage from the revision date

Consequences of Non-Compliance
- Labour inspector finds workers paid below minimum wage → Recovery of difference for past 6 months
- Penalty: up to Rs. 500 per violation (per worker per month underpaid) — multiplied across all affected workers
- Criminal prosecution: employer (managing director / director) liable for imprisonment up to 5 years
- Damages: court may award up to 10 times the underpaid amount in some states

The Code on Wages 2019
The Code on Wages 2019 consolidates the Minimum Wages Act, Payment of Wages Act, Equal Remuneration Act, and Payment of Bonus Act. When implemented (state by state implementation in progress), it will introduce:

- Simplified wage definition
- Digital wage payment requirement
